Ruthless Health Law
Abstract
This perspective article examines the potential consequences of a Supreme Court challenge to the Affordable Care Act (ACA) in California v. Texas, particularly in the absence of Justice Ruth Bader Ginsburg, who was a staunch advocate for equality and health care access. The case hinges on the constitutionality of the ACA's individual mandate and its severability from the rest of the law. The author highlights Ginsburg's legacy in defending health care equity, reproductive rights, and gender equality, emphasizing her rulings that underscored the importance of universal health coverage and women's autonomy over their reproductive choices. The article warns of the chaos and inequities that could arise if the ACA is dismantled, especially during the COVID-19 pandemic, which has exacerbated existing disparities in health care access.
